Thank you so much for allowing Valenbakes to be a part of your celebration! Below are the terms and conditions pertaining to your custom order. Please read through the following information carefully and do not hesitate to contact us with any questions or concerns.
Deposit
Payment of a 25% non-refundable deposit is required to reserve your date and consider our engagement a contract for services to be rendered. No order will be booked or prepared until the deposit has been received.
Please confirm that all information (including event date, flavors, design details, and delivery/pickup information) is correct on your invoice prior to paying the deposit. By paying the deposit, you agree to all of Valenbakes’ terms and conditions stated herein.
You and Valenbakes acknowledge and agree that the Deposit shall constitute liquidated damages and not penalties, should you breach this agreement. The parties further acknowledge that (i) the amount of loss or damages likely to be incurred by Valenbakes as a result of a breach is difficult to precisely estimate, and (ii) the Deposit bears a reasonable relationship to the probable loss likely to be incurred.
Final Payment
The remaining balance for your Order is due three (3) days prior to the scheduled delivery or pick-up date. Your Order will not be provided if full payment is not received on or before this date, which may result in the cancellation of your Order without refund of the deposit.
Cancellations/Postponements
You are responsible for notifying Valenbakes in writing (e.g., via email) of any date changes or your intent to cancel your Order.
- A credit for future use (valid for 12 months) may be issued for cancellations or postponements communicated more than seven (7) days prior to the scheduled event date, at Valenbakes’ discretion.
- No credit or refund will be issued for cancellations or postponements communicated within seven (7) days of the scheduled event date, and the full remaining balance for your Order will also be due and payable.
Order & Design Changes
We understand that plans can evolve. Design changes are accepted up to seven (7) days prior to the scheduled event date. Any changes requested after this date cannot be guaranteed and may be subject to additional charges based on the complexity and materials required. Significant changes may require a revised quote.
Pick Up / Delivery / Late Fee
Pickup:
- If you or your representative chooses to pick up and set up your Order, you assume all liability and responsibility for its condition once it has left our possession. Valenbakes is not liable for any damages due to negligence or improper handling (including collapse, melting, physical damage, etc.) once your Order has been picked up.
- The standard pickup location is in Aubrey, TX. The precise address and instructions will be provided once your order is booked and confirmed.
- Pickup times must be adhered to. Our general pickup windows are:
- Monday – Friday: 5:00 PM – 8:00 PM
- Saturday: 11:00 AM – 4:00 PM
- Sunday: 11:00 AM – 1:30 PM(All pickups are by appointment only within these windows).
- Please be considerate of your scheduled pickup time. Late arrivals without prior communication may result in rescheduling difficulties.
- A late fee may be applied for significantly delayed pickups:
- $15 for 30-59 minutes past scheduled time.
- $40 for 60+ minutes past scheduled time.
- Late fees must be paid before Valenbakes will release your Order.
Delivery:
- Delivery availability and fees vary based on location and date. Please inquire for a quote.
- Valenbakes is not responsible for damages after the Order setup is complete.
- You are responsible for providing a suitable environment for your Order upon delivery (e.g., sturdy table, cool temperature away from direct sunlight or heat sources).
Care Instructions:
- You are responsible for providing a suitable environment for your Order (away from heaters, direct sunlight, vibrations, people). Cakes are perishable and require care.
- Most cakes should be refrigerated until approx. 1-2 hours before serving unless otherwise specified. Once removed from refrigeration, store at optimal room temperature (ideally 70°F/21°C or below).
- Cakes can be heavy and require a sturdy, level table.
- Detailed care instructions specific to your order will be provided upon pickup or delivery.
Quality
We pride ourselves on the quality of our products and services. It is important to remember that cakes and desserts are perishable and delicate products. Once you take possession of your Order (via delivery or pick-up), factors relating to care, transportation, and environment may result in quality being compromised or damage occurring that is beyond our control or responsibility. Care instructions must be followed thoroughly to maintain the quality, freshness, and design of your Order.
Serving Size
Guidance on how to cut tiered cakes to maximize servings can be provided upon request. If specific serving numbers are critical, please discuss this during the ordering process. Valenbakes is not liable for any serving shortage if cutting guidance is not followed or if portion sizes differ from standard recommendations.
Emergencies / Force Majeure
Neither party shall be responsible for any failure to fulfill its obligations under this contract due to causes beyond its reasonable control, including but not limited to acts or omissions of government/military authority, acts of God, shortages of materials, transportation delays, fires, floods, pandemics, labor disturbances, riots, or wars (“Force Majeure Event”), provided that the affected party gives prompt notice to the other and makes diligent efforts to resume performance. If Valenbakes cannot deliver your Order due to a Force Majeure Event impacting our operations, a full refund or credit for future use will be issued.
Allergies
Our products are prepared in a kitchen environment where soy, eggs, gluten, dairy, nuts (including tree nuts and peanuts), and other allergens are present. Please advise us during the ordering process of any known allergies so that appropriate care may be taken.
While we use best practices to minimize the risk of cross-contamination, we cannot guarantee that any product will be completely free from potential allergens. It is your responsibility to inform your guests of potential allergens. Valenbakes disclaims all liability for allergic reactions or complications resulting from the consumption of our products.
Disclaimer
We are dedicated to satisfying our clients’ requirements. In the unlikely event that you are genuinely dissatisfied with your Order upon receipt, please contact us on the day of your event to explain the situation. You must provide clear photographs documenting any issue(s) to be eligible for consideration of a partial or full refund or credit, though a refund/credit is not guaranteed and will be assessed on a case-by-case basis at the discretion of Valenbakes. Issues reported after the event date will not be eligible for consideration.
